Introduction to the Law on Prevention and Control of Occupational Diseases
Law of the People's Republic of China on the Prevention and Control of Occupational Diseases (hereinafter referred to as the Law on the Prevention and Control of Occupational Diseases)

The meeting was adopted on October 27, 2001, and came into force on May 1, 2002.
The Law on the Prevention and Control of Occupational Diseases consists of seven chapters, from Chapter 1 to Chapter 7, which are:

1. Legislative Purpose
In order to prevent, control and eliminate occupational disease hazards, prevent and control occupational diseases, and protect the health of workers
Health and its related rights and interests, and promote economic development.
2. Relevant provisions of the Law on the Prevention and Control of Employment Disorders
1. The responsibility for the prevention and control of occupational diseases lies in the enterprise, and it is the responsibility of the enterprise to protect the health of workers
2. Occupational disease prevention and control adhere to the policy of "prevention first, combined with prevention and treatment", and implement classified management and comprehensive management.
3. Employers shall establish and improve the responsibility system for occupational disease prevention and smelting, improve the level of occupational disease prevention and smelting, and assume responsibility for occupational disease hazards generated by their own units.
4. For workers who are exposed to occupational disease hazards, the employer shall, in accordance with the regulations of the State Council's health administrative department, organize occupational health examinations before, during and on the job, and truthfully inform the workers of the results.
3. The right to occupational health protection enjoyed by workers in accordance with the law
Workers of all employers are protected by the Law on the Prevention and Control of Occupational Diseases. Regardless of the nature and economic type of the employer, whether it has signed a labor contract (including an employment contract) with the employee, as long as the employer has a de facto employment relationship with the employee, the employee is properly protected by this law. The occupational health protection rights enjoyed by workers in accordance with the law include:
① The right to education and training. Obtain occupational health education and training according to law.
②Health service branch. Obtain occupational health inspection, occupational disease diagnosis and treatment, rehabilitation and other occupational disease prevention and treatment services in accordance with the law.
③ Right to know. The right to know the occupational disease hazards that occur or may occur in the workplace, the degree of hazards, the consequences of hazards, protective measures and related treatment, etc.
④ The right to occupational health protection. The right to require employers to provide occupational disease protection facilities that meet the requirements for preventing occupational diseases and occupational disease protection articles for personal use to improve working conditions.
⑤ The right to criticize, report, and accuse. Criticize, report and accuse behaviors that violate occupational disease prevention laws and regulations and endanger life and health.
⑥ The right to refuse illegal operations. Youbi refuses to give orders in violation of regulations and forcibly carry out operations without occupational disease protection measures.
⑦ Participate in decision-making power. Participate in the democratic management of the occupational health work of the employer, and put forward opinions and suggestions on the prevention and control of occupational diseases.
⑧ The right to social insurance for work-related injuries.
⑨ The right to compensation. The right to claim compensation for health damage caused by occupational disease hazards
① The right to special protection. Juvenile workers, female workers, and workers with special physiological or pathological conditions shall enjoy special occupational health protection in accordance with the law.
4. Four obligations of workers to prevent occupational diseases
1. Consciously learn and master relevant occupational health knowledge.
2. Consciously abide by the laws, regulations, rules and operating procedures for the prevention and control of occupational diseases.
3. Correct use and maintenance of occupational disease protection facilities and occupational disease protection equipment for personal use.

Occupational Hazards and Basic Concepts of Occupational Diseases
1. What are occupational hazards? What are the types of occupational hazards?
Occupational disease hazards refer to various hazards that may cause occupational diseases to workers engaged in occupational activities.
Occupational disease hazard factors include: various physical, chemical and biological factors that exist in occupational activities and other occupational hazard factors generated in the process of operation.
2. The basic concept of occupational disease
Occupational diseases in a broad sense: diseases caused by occupational difficulties.
Statutory occupational diseases: Statutory occupational diseases refer to occupational diseases expressly stipulated by the competent authorities of the national government, such as noise deafness, chrome nose disease, tooth erosion disease, etc. According to the "Classification and Catalogue of Occupational Diseases" issued by four departments including the National Health and Family Planning Commission in 2013, there are 132 types of statutory occupational diseases in 10 categories.
